Prosecutor to Review Police Report Today in Fatal Shooting

9/4/14 - Charges could be filed today against the Howell man arrested after police say he shot and killed a fellow motorist Tuesday afternoon in Genoa Township. Livingston County Prosecutor Bill Vailliencourt says he anticipates receiving the police report this morning and that after a thorough review, he’ll announce what, if any, charges will be filed against the 69-year-old suspect in the case. On Wednesday, new details emerged about the incident, including the name of the victim; 43-year-old Derek Flemming of Howell. That’s according to attorney William Moore, who was hired by the Flemming family. Moore said the suspect drove dangerously close to the Flemming’s car as they drove on Grand River on their way to pick up their kids from the first day of school. Moore says the suspect then pulled in front of them at which point he repeatedly accelerated and hit the brakes. Moore says the incident came to a climax when they reached the Chilson Road intersection. He says Flemming got out to approach the suspect's pickup truck and asked, "What's your problem?" He says the suspect immediately opened fire and killed Flemming and that there was no physical confrontation between the two. Moore went on to say he hoped "police and prosecutors do their job in bringing the man responsible to justice." Moore added that the suspect, "...shot an unarmed man in broad daylight with multiple witnesses, including Mrs. Flemming. “ The suspect, who police have declined to identify, remains jailed pending the issuance of charges. He has reportedly declined to cooperate with investigators. Flemming is pictured here with his children. (JK)
